Welcome to CSP Studio. These Terms & Conditions (“Terms”) govern your use of our website and services related to wedding photography and videography. By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Definitions
In these Terms:
- “Company”, “we”, “our”, or “us” refers to CSP Studio.
- “Client”, “you”, or “your” refers to any individual or entity using our website or booking our services.
- “Services” refers to photography, videography, drone services, editing, album design, and related creative services provided by CSP Studio.
2. Booking & Payment
2.1 Booking Confirmation
A booking is only confirmed after:
- A signed agreement or written confirmation is received; and
- The required booking fee/deposit has been paid.
2.2 Deposit
All deposits paid are non-refundable unless otherwise stated in writing.
2.3 Full Payment
The remaining balance must be paid according to the agreed payment schedule. Failure to complete payment may result in suspension of service delivery, including withholding edited photos/videos.
2.4 Late Payments
We reserve the right to impose late payment charges or suspend services for overdue invoices.
3. Cancellation & Rescheduling
3.1 Client Cancellation
If the Client cancels the booking:
- Deposits are non-refundable;
- Any work already completed may be chargeable;
- Additional costs incurred prior to cancellation may be billed to the Client.
3.2 Rescheduling
Rescheduling requests are subject to our availability. We will make reasonable efforts to accommodate date changes.
3.3 Force Majeure
We shall not be liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Severe weather
- Government restrictions
- Pandemic-related disruptions
- Accidents or emergencies
4. Creative Style & Editing
The Client acknowledges that:
- The final editing style, composition, and artistic direction remain at the discretion of CSP Studio;
- RAW/unedited files are not provided unless agreed otherwise in writing;
- Editing revisions are limited to reasonable minor adjustments unless additional editing services are purchased.
5. Delivery Timeline
Estimated delivery timelines will be communicated during booking. Delivery times may vary depending on:
- Event season workload
- Editing complexity
- Client response time
We are not responsible for delays caused by incomplete information or delayed client feedback.
6. Client Responsibilities
The Client agrees to:
- Obtain permission from venues or authorities where required;
- Ensure cooperation from guests and participants;
- Provide accurate event schedules and information;
- Arrange meals and reasonable breaks for the photography/videography team for long-hour events where applicable.
We are not responsible for missed shots caused by:
- Late arrivals
- Restricted venue access
- Interference from guests/vendors
- Schedule delays
7. Copyright & Usage Rights
7.1 Ownership
All photographs, videos, and creative content produced by CSP Studio remain the intellectual property of CSP Studio unless otherwise agreed in writing.
7.2 Client Usage
Clients are granted personal, non-commercial usage rights for delivered materials.
Clients may not:
- Resell the content;
- Alter the work excessively;
- Use the materials for commercial advertising without written permission.
7.3 Portfolio & Marketing Use
We reserve the right to use selected images/videos for:
- Portfolio display
- Website showcase
- Social media marketing
- Advertising and promotional purposes
Clients who prefer privacy may request a written non-disclosure arrangement before the event date.
8. Drone Services
Drone operations are subject to:
- Weather conditions;
- Venue restrictions;
- Local aviation regulations and safety requirements.
We reserve the right to cancel drone operations if conditions are deemed unsafe or prohibited by law.
9. Limitation of Liability
While we take reasonable care in performing our services:
- We shall not be liable for indirect, incidental, or consequential damages;
- Our maximum liability shall not exceed the total amount paid by the Client for the affected services;
- In the unlikely event of equipment failure, data loss, illness, or emergency, liability is limited to refunding payments received or arranging a replacement service where possible.
10. Website Usage
By using our website, you agree not to:
- Misuse or interfere with website functionality;
- Attempt unauthorized access to servers or systems;
- Reproduce website content without permission.
All website content, including images, logos, branding, and text, belongs to CSP Studio unless otherwise stated.
11. Privacy
Any personal information collected through our website or booking process will be handled in accordance with applicable privacy laws and our Privacy Policy.
12. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Malaysia.
Any disputes arising from these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
